RobeMart is a trading name of SATAY INTERNATIONAL, a California corporation with its principal place of business at 12363 Doherty Street, Riverside, CA 92503, United States ("RobeMart," "we," "us," or "our"). We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). RobeMart is powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy.

Who This Policy Is For

The Services are directed to customers in the United States and Canada. We ship to the continental United States, U.S. territories, and Canada. We do not offer goods or services to individuals in the European Economic Area or the United Kingdom. If you previously ordered from us at an address in those regions, see Former EEA and UK Customers below.

Personal Information We Collect or Process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

  • Contact details including your name, address, billing address, shipping address, phone number, and email address.
  • Financial information including transaction details, form of payment, payment confirmation, billing address, and the last four digits and card type of the payment method used. We do not store full credit or debit card numbers. Card details are collected and processed directly by our payment processors under their own security standards, and we do not have access to them.
  • Account information including your username, password, security questions, preferences and settings.
  • Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
  • Personalization and customization content including any names, monograms, text, logos, artwork, images, or other materials you submit to us for embroidery or other personalization, together with any related instructions or approvals.
  • Wholesale and business account information including business name, resale or tax exemption certificates, business contact details, and related verification information, where you apply for a wholesale account.
  • Rewards program information including your points balance, redemption history, referrals, and related activity, where you participate in RobeMart Rewards.
  • Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry or contacting us about an accessibility barrier.
  • Reviews and user content including any reviews, ratings, photographs, or testimonials you choose to submit.
  • Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
  • Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

Sensitive Personal Information

Some of the information we collect falls within the definition of "sensitive personal information" under the California Consumer Privacy Act and comparable categories of sensitive data under other U.S. state privacy laws. Specifically, we collect account log-in credentials, and limited payment information such as billing address and the last four digits of your card. As noted above, we do not store full card numbers.

We use this information only for purposes that are permitted without triggering a right to limit, namely: to provide the Services you request, to authenticate you and secure your account, to process your transactions, to prevent and investigate fraud, and to comply with law. We do not use or disclose sensitive personal information to infer characteristics about you, and we do not sell or share it or use it for advertising.

We do not collect information about your racial or ethnic origin, religious or philosophical beliefs, union membership, health, sex life or sexual orientation, genetic or biometric data, precise geolocation, Social Security number, driver's licence or state identification number, or passport number.

Personal Information Sources

We may collect personal information from the following sources:

  • Directly from you including when you create an account, visit or use the Services, place an order, apply for a wholesale account, submit personalization artwork, communicate with us, or otherwise provide us with your personal information;
  • Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;
  • From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;
  • From our partners or other sources who help us operate and improve the Services, including advertising partners, analytics providers, fraud prevention services, and shipping carriers.

How We Use Your Personal Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

  • Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to produce personalized and embroidered items, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to administer wholesale accounts and the RobeMart Rewards program, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.
  • Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services. We do not share your mobile opt-in information or text-messaging consent with any third parties or affiliates for their own marketing or promotional purposes.
  • Security and Fraud Prevention. We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.
  • Communicating with You. We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you.
  • Legal Reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.

Automated Processing

We use automated tools to recommend products, to personalize the advertising you see, and to screen orders for indications of fraud. Orders that our fraud screening tools flag as high risk are declined automatically, without a person reviewing them first.

If your order was declined and you believe that was a mistake, please contact us using the details in the Contact section below and a member of our team will review it.

We do not use automated processing to make decisions about credit or lending, housing, insurance, employment, education, or healthcare.

How We Disclose Personal Information

We disclose personal information to the following categories of recipients, for the business purposes described above:

  • Service providers and processors that perform services on our behalf, including our e-commerce platform (Shopify), payment processors, shipping and fulfillment carriers, embroidery and production partners, email and SMS messaging providers, customer support and live chat providers, reviews and rewards platform providers, analytics providers, and IT and hosting providers.
  • Advertising and analytics partners that help us deliver and measure advertising, including on social media and other websites. Disclosures to these partners may be considered a "sale" or "sharing" of personal information under certain U.S. state privacy laws. See Your Privacy Choices to opt out.
  • Professional advisors such as our lawyers, accountants, auditors, and insurers.
  • Law enforcement, regulators, and other parties where required by law, valid legal process, or to protect our rights, your safety, or the safety of others.
  • Parties to a business transaction in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets.

Sale and Sharing of Personal Information

We do not exchange your personal information for money. However, the legal definition of a "sale" is broader than that and covers disclosures for other valuable consideration. We disclose identifiers, device and usage information, transaction information, and inferences to advertising partners in order to show you advertising that is more relevant to your interests across other websites and apps. Under the California Consumer Privacy Act and several other U.S. state privacy laws, this may be considered a "sale" or "sharing" of personal information for cross-context behavioral advertising or targeted advertising.

You have the right to opt out of this activity. You can do so at any time on our Your Privacy Choices page, by enabling the Global Privacy Control signal in your browser, or by contacting us using the details in the Contact section below.

Text message opt-in data is excluded. Text messaging originator opt-in data and consent are never sold, shared, or disclosed to any third party for that party's own marketing or promotional purposes. This information is disclosed only to the aggregators and service providers that help us deliver our text messaging service.

We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

Cookies and Similar Technologies

We and our service providers use cookies, pixels, tags, local storage, and similar technologies on the Services. These fall into the following categories:

  • Strictly necessary. Required to operate the Services, including maintaining your cart, keeping you signed in, load balancing, and security. These cannot be switched off.
  • Performance and analytics. Help us understand how visitors use the Services so we can improve them.
  • Functional. Remember your preferences, such as region, currency, or recently viewed items.
  • Advertising and targeting. Used by us and our advertising partners to deliver and measure advertising relevant to your interests, including on other websites.

You can manage your choices for advertising cookies through our Your Privacy Choices page. Most browsers also let you block or delete cookies through their settings; blocking strictly necessary cookies may prevent parts of the Services from working. We honor the Global Privacy Control opt-out preference signal as described below. Other than the Global Privacy Control, we do not respond to "Do Not Track" signals.

SMS/Text Message Program

We offer a recurring SMS/text message program that allows you to receive transactional and marketing text messages from RobeMart, such as order and shipping updates, cart reminders, customer service responses, exclusive offers, promotions, and product announcements.

Eligibility. You must be at least 18 years old to enroll. By enrolling, you represent that you are the subscriber to, or the customary user of, the mobile number you provide, and that you are authorized to consent to receive messages at that number. If you give up or change that number, you agree to notify us promptly using the contact details below.

How to opt in. You can opt in to receive text messages by providing your mobile phone number and affirmatively consenting through one of our designated sign-up methods, such as entering and submitting your number at checkout or in your account settings, completing a sign-up form on our website, or texting a designated keyword to our published number. By opting in, you consent to receive recurring automated marketing and transactional text messages at the mobile number you provide. Consent to receive marketing text messages is not a condition of any purchase.

Message frequency. Message frequency varies based on your interactions with us and the messages you have opted into. For example, you may receive recurring messages such as order and shipping notifications and periodic promotional messages.

Message and data rates. Message and data rates may apply, depending on your mobile carrier's plan and your usage. RobeMart is not responsible for any charges imposed by your wireless carrier.

How to opt out. You can opt out of the SMS program at any time, using any reasonable method. The simplest is to reply STOP to any text message you receive from us; we also honor replies such as END, QUIT, CANCEL, UNSUBSCRIBE, or REVOKE. You may also opt out by emailing us at info@robemart.com, by calling us at (844) 762-6278, or by telling any member of our customer service team. We will honor your request within 10 business days of receiving it. After you opt out, we will send you a one-time confirmation message and will stop sending you text messages, except as needed to confirm your opt-out.

How to rejoin. If you opt out and later wish to receive messages again, simply sign up again as you did originally.

Mobile information sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. Text messaging originator opt-in data and consent will not be shared with any third parties, except for the aggregators and service providers that help us deliver the Text Message services. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Carrier disclaimer. Carriers are not liable for delayed or undelivered messages.

Third Party Websites and Links

The Services may provide links to websites or other online platforms operated by other parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on social networking platforms, may also be viewable by other users of the Services and/or users of those platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children's Data

The Services are intended for use only by individuals aged 18 or over. We do not knowingly collect personal information from anyone under 18. If you are the parent or guardian of a minor who has provided us with personal information, please contact us using the details below and we will delete it and close any account.

We do not have actual knowledge that we "sell" or "share" (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.

Security and Retention of Your Information

We maintain administrative, technical, and physical safeguards designed to protect your personal information. Where a security breach affecting your personal information occurs, we will notify you and the relevant authorities where and when applicable law requires it. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

We keep personal information only for as long as we need it for the purposes described in this Privacy Policy. How long that is depends on the type of information and why we hold it. The criteria we apply are:

  • Whether we need it to provide the Services to you — for example, we keep your account information for as long as your account is open, and your order history for as long as it is needed to support returns, exchanges, warranty claims, and reorders of personalised items.
  • Whether we are legally required to keep it — tax, accounting, and sales tax records must be retained for periods fixed by federal and state law, which is generally several years.
  • Whether we need it to evidence your choices — we keep records of marketing and text messaging consent and opt-out for as long as necessary to demonstrate that we honoured them, and we keep a minimal suppression record indefinitely, because that is the only reliable way to ensure we never contact you again after you opt out.
  • Whether we need it to resolve a dispute or enforce our agreements — including for the duration of any applicable limitation period.
  • Whether the information still serves a purpose — information no longer needed for any of the above is deleted or anonymised.

We may retain information for longer where necessary to comply with a legal obligation, resolve a dispute, or enforce our agreements.

Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right to Access / Know. You may have a right to request access to personal information that we hold about you, including the categories we collect, the sources, the purposes, and the categories of parties to whom we disclose it.
  • Right to Delete. You may have a right to request that we delete personal information we maintain about you.
  • Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
  • Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to another party, in certain circumstances and with certain exceptions.
  • Right to Opt out of Sale or Sharing for Targeted Advertising. Depending on where you reside, you may have a right to opt out of the "sale" or "share" of your personal information or to opt out of the processing of your personal information for purposes considered to be "targeted advertising", as defined in applicable privacy laws. You can exercise this right on our Your Privacy Choices page. For clarity, text messaging originator opt-in data and consent are excluded from any such "sale" or "sharing"; this information will not be shared with any third parties, except for the aggregators and service providers that help us deliver the Text Message services. Please note that if you visit our website with the Global Privacy Control opt-out preference signal enabled, depending on where you are, we will automatically treat this as a request to opt-out for the device and browser that you use to visit the website. To learn more about Global Privacy Control, you can visit https://globalprivacycontrol.org/. Other than the Global Privacy Control, we do not recognize other "Do Not Track" signals that may be sent from your web browser or device.
  • Right to Limit Use of Sensitive Personal Information. As described above, we do not use or disclose sensitive personal information for purposes that would trigger this right.
  • Managing Communication Preferences. We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made. You may opt out of promotional text messages at any time as described in the SMS/Text Message Program section above.

How to Submit a Request

You can submit a request to exercise your rights by emailing info@robemart.com, by calling us at (844) 762-6278, or by writing to us at the postal address in the Contact section below.

We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law, generally within 45 days, with the possibility of an extension where permitted, in which case we will tell you.

Right to Appeal

If we decline to act on your request, you may appeal that decision by emailing info@robemart.com with the subject line "Privacy Request Appeal" within 30 days of our response. We will respond to your appeal in writing within the period required by the law of your state, generally 45 or 60 days, and will explain the reasons for our decision. If your appeal is denied, you may contact your state Attorney General to submit a complaint.

Notice for California Residents

This section supplements the information above and applies to California residents.

Summary of our collection practices. The categories of personal information we collect, the purposes for collecting them, whether they are sold or shared, and our retention periods are described in the Personal Information We Collect or Process, How We Use Your Personal Information, Sale and Sharing of Personal Information, and Security and Retention of Your Information sections above.

Notice of Financial Incentive — RobeMart Rewards. RobeMart Rewards offers members points that can be redeemed for discounts on future orders. Because taking part involves our collecting and using your personal information, the program may be a "financial incentive" under California law.

Material terms. Membership is free and entirely voluntary. You may join at any time through your account, and you may withdraw at any time by contacting us at info@robemart.com. Withdrawing does not affect your ability to shop with us. The full program rules are set out in our Terms of Service.

Our good-faith estimate of value. We do not sell your personal information and we do not assign it a separate monetary value. We estimate the value of the incentive to you as equal to the value of the rewards you redeem, calculated as the total value of discounts redeemed by members divided by the number of participating members. We offer the program to encourage repeat custom rather than to compensate you for your personal information, and we reasonably believe the value of the program bears a direct relationship to the value your continued custom provides to us.

Shine the Light. California Civil Code Section 1798.83 permits California residents to request information about the personal information we disclosed to third parties for those third parties' own direct marketing purposes during the preceding calendar year. To make such a request, email info@robemart.com with "Shine the Light Request" in the subject line. We do not currently disclose personal information to third parties for those third parties' own direct marketing purposes.

Notice for Canadian Residents

We handle the personal information of Canadian customers in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, including Quebec's Law 25. You may request access to, or correction of, the personal information we hold about you, and you may withdraw your consent to certain processing, subject to legal and contractual restrictions. Our Privacy Officer can be reached at info@robemart.com. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada or, in Quebec, the Commission d'accès à l'information du Québec.

Former EEA and UK Customers

The Services are not directed to individuals in the European Economic Area or the United Kingdom, and we do not ship to those regions. We therefore do not offer goods or services to, or monitor the behaviour of, individuals located there.

We previously fulfilled a small number of orders to addresses in the EEA and the UK. If you were one of those customers, you may contact us using the details in the Contact section below to request access to, correction of, or deletion of the personal information we hold about you, or to object to or restrict our processing of it. We will handle your request in accordance with applicable law.

Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision as described in the Right to Appeal section above, or to lodge a complaint with your state Attorney General or, in Canada, with the Office of the Privacy Commissioner of Canada.

International Transfers

We are located in the United States. Your personal information is stored and processed in the United States, and may also be processed by our service providers in other countries where they operate. If you are located outside the United States, please note that your personal information will be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your country.

Where we transfer personal information from Canada to the United States, we do so in reliance on contractual protections with our service providers and on the safeguards described in the Security section above.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date and provide notice as required by applicable law. Where changes are material, we will provide additional notice, such as by email or a prominent notice on the Services.
